JMEC Board Asserts Legal Counsel ‘Mischaracterized The Settlement Proposal’

Consistent with the Court’s rules and general policies, the Board of Jemez Mountains Electric Cooperative, Inc. (JMEC) made a good faith effort to settle the lawsuit filed by former Board member Bruce Duran. Unfortunately, in an e-mail sent by the plaintiffs’ counsel to several members of the media, plaintiffs’ counsel publicized and completely mischaracterized the settlement proposal made by the Board’s counsel to settle the litigation. The Board’s counsel acted in the long term interest of the entire membership and JMEC’s 31,000 customers to bring to resolution the pending litigation, rather than continue in protracted and expensive litigation. Plaintiffs’ counsel completely mischaracterized the settlement offer as a “bribe.” The Board has not attempted to “bribe” anyone, but made a good faith settlement proposal in an effort to minimize costs, bring the litigation to resolution, and enable JMEC to move forward. With its settlement offer, the Board also considered the potential exposure from litigation JMEC faces from potential contractors and employees if Mr. Duran continues on the Board.

The Board will continue to defend its determinations made regarding the Board of trustee
elections held in June 2019, and is currently pursuing its defense in the ongoing legal
proceedings.
